The Control of Asbestos Regulations 2012
Until the 1990′s most buildings contained Asbestos, and even until the year 2000 Asbestos may be found in some buildings. It was considered a ‘miracle ingredient’ and was added to increase the strength and durability of products.
By Law you must have an asbestos management plan such as that provided by an asbestos survey conducted on any non-domestic property that was built before the year 2000. OK, but what’s the worst that can happen if you don’t comply with the law?
As well as potentially putting at risk the health and safety of your staff and customers, the duty holder could be liable for any or all of the following:
- Closure of the premises
- Personal fines of up to £20,000
- Disqualification from Directorship
- A custodial sentence
These might sound like extreme measures but asbestos is potentially a very dangerous substance – currently in the UK, 3,500 people die each year as a result of exposure to asbestos.
In addition, many insurance companies may refuse to renew your policy unless you have identified any potential asbestos risks and developed an asbestos management plan.

As of January 2010 there are two types of asbestos survey, “Asbestos Management Survey” (formally Type 2) and “Asbestos Refurbishment and Demolition Survey” (formally Type 3).
Each one fits a relevant situation, the most commonly carried out by an asbestos surveyor in the UK is a asbestos management survey whereby in addition to a complete survey of the building any suspect materials are tested in a laboratory to determine the presence of asbestos.
